　　　　　　Having the honour to refer to the commitments of the People's Republic of China arising from the Protocol of Accession of the People's Republic of China to the Marrakesh Agreement establishing the World Trade Organization and the Report of the Working Party, on behalf of the Government of the People's Republic of China, I hereby apply for accession to the Agreement on Government Procurement and submit our initial offer.

General Notes

1.　　　　　　　　  This Agreement shall not apply to procurement of agricultural products made in furtherance of agricultural support programmes or human feeding programmes.

2.　　　　　　　　  This Agreement shall not apply to procurement subject to secrecy or other particular restrictions with regard to national safety.

3.　　　　　　　　  When a specific procurement may impair national policy objectives, the Chinese Government may consider it necessary in singular procurement cases to deviate from the principle of national treatment in this Agreement.

4.　　　　　　　　  This Agreement shall not apply to any procurement made by a covered entity on behalf of a non-covered entity.

5.　　　　　　　　  This Agreement shall not apply to procurement or acquisition of services not covered by Annex 4, by entities whether or not listed in Annexes 1 to 3, including:

　　　　　　- fiscal agency or depository services;

　　　　　　- liquidation and management services for regulated financial institutions;

　　　　　　-　　　　　 services related to the sale, redemption and distribution of public debt, including loans and government bonds, notes and other securities;

　　　　　　- public employment contracts;  and

　　　　　　-　　　　　 contracts for the acquisition, development, production or co-production of programme material by broadcasters and contracts for broadcasting time.

6.　　　　　　　　  This Agreement shall not apply to procurement of construction services not covered by Annex 5 by entities whether or not listed in Annex 1 to 3.

7.　　　　　　　　  This Agreement shall not apply, under any circumstances, to procurement of infrastructure construction and related supplies and services for public utilities, including roads, railways, civil aviation, ports, urban transportation, electricity, water resources, energy, postal services, and telecommunications, etc.

8.　　  This Agreement shall not apply to:

(1)　　  procurement of products or services for commercial sale or resale;

(2)　　  procurement including non-contractual agreements or any form of government assistance, such as cooperative agreements, grants, loans, equity infusions, guarantees and fiscal incentives;

(3)　　  procurement with the aim of supporting small and medium-sized enterprises and promoting development in minority and poverty-stricken areas;

(4)　　  procurement for the purpose of strategic reserves and disaster relief;

(5)　　  procurement for international assistance, including development aid;

(6)　　  procurement under the particular procedure or condition of an international agreement relating to the stationing of troops or relating to the joint implementation by the signatory countries of a project;  or

(7)　　  procurement under the particular procedure or condition of an international organization, or funded by international grants, loans or other assistance where the applicable procedure or condition would be inconsistent with this Agreement.

9.　　　　　　　　  Having regard to Article XVI of this Agreement and general policy considerations regarding development, the Chinese Government may require the incorporation of domestic contents, offset procurement or transfer of technology.

10.　　　　　　  The offer by China, with respect to condition and scope in all Annexes, is subject to negotiation of mutually acceptable commitments with other Parties on reciprocal basis.

11.　　　　　　  China shall implement the obligations of this Agreement 15 years after its accession to this Agreement.
